1.1 Die vorliegenden Datenschutzinformationen gelten für die Verarbeitung personenbezogener Daten beim Betrieb der Plattform ideatio – das ist die Website ideatio.ai samt den Online-Werkzeugen der fünf Stationen „Verstehen“, „Entdecken“, „Entscheiden“, „Umsetzen“ und „Überzeugen“ sowie der kostenlosen „Kostprobe“ – durch Mag. Dr. Gerold Weiß.

1.1 This privacy information applies to the processing of personal data in the operation of the ideatio platform – that is, the website ideatio.ai together with the online tools of the five stations “Verstehen”, “Entdecken”, “Entscheiden”, “Umsetzen” and “Überzeugen” as well as the free “Kostprobe” (taster) – by Mag. Dr. Gerold Weiß.

1.2 Der Schutz persönlicher Daten und die Einhaltung der maßgeblichen Datenschutzvorschriften – derzeit der Verordnung (EU) 2016/679 (Datenschutz-Grundverordnung, „DSGVO“) und des Datenschutzgesetzes in der jeweils geltenden Fassung („DSG“) – haben bei Mag. Dr. Gerold Weiß höchste Priorität. Diese Informationen geben gemäß Art 12 und 13 DSGVO einen Überblick, welche personenbezogenen Daten beim Betrieb der Plattform zu welchen Zwecken verarbeitet werden und wie deren Schutz gewährleistet wird.

1.2 The protection of personal data and compliance with the relevant data protection rules – currently Regulation (EU) 2016/679 (General Data Protection Regulation, “GDPR”) and the Austrian Data Protection Act as amended (“DSG”) – are of the highest priority to Mag. Dr. Gerold Weiß. In accordance with Art 12 and 13 GDPR, this information provides an overview of which personal data are processed in the operation of the platform, for which purposes, and how their protection is ensured.

1.3 Diese Datenschutzinformationen können auf der Website ideatio.ai elektronisch abgerufen, ausgedruckt, heruntergeladen und gespeichert werden.

1.4 Die verwendeten Begriffe verstehen sich im Sinne der Definitionen gemäß Art 4 DSGVO.

2. Verantwortlicher, Datenschutzbeauftragter

2. Controller, data protection officer

2.1 Verantwortlicher im Sinne des Art 4 Z 7 DSGVO ist Mag. Dr. Gerold Weiß (Kontaktdaten siehe Punkt 1.1).

2.1 The controller within the meaning of Art 4(7) GDPR is Mag. Dr. Gerold Weiß (contact details see point 1.1).

2.2 Da die Voraussetzungen des Art 37 Abs 1 DSGVO nicht erfüllt sind – insbesondere besteht die Kerntätigkeit nicht in Datenverarbeitungsvorgängen, die eine umfangreiche regelmäßige und systematische Überwachung betroffener Personen erforderlich machen – ist kein Datenschutzbeauftragter benannt.

2.2 As the conditions of Art 37(1) GDPR are not met – in particular, the core activity does not consist of processing operations that require large-scale, regular and systematic monitoring of data subjects – no data protection officer has been appointed.

3. Verarbeitung personenbezogener Daten im Allgemeinen

3. Processing of personal data in general

3.1 Personenbezogene Daten natürlicher Personen („betroffene Personen“) werden nur unter Wahrung der in Art 5 ff DSGVO niedergelegten Grundsätze und nur dann verarbeitet, wenn mindestens eine Rechtmäßigkeitsbedingung im Sinne des Art 6 DSGVO erfüllt ist.

3.1 Personal data of natural persons (“data subjects”) are processed only in accordance with the principles set out in Art 5 ff GDPR and only where at least one lawfulness condition within the meaning of Art 6 GDPR is met.

3.2 Es werden keine besonderen Kategorien personenbezogener Daten im Sinne des Art 9 Abs 1 DSGVO („sensible Daten“) verarbeitet.

3.2 No special categories of personal data within the meaning of Art 9(1) GDPR (“sensitive data”) are processed.

3.3 Erforderlichenfalls wird die Einwilligung der betroffenen Person(en) eingeholt.

3.3 Where necessary, the consent of the data subject(s) is obtained.

3.4 Eine Offenlegung oder Übermittlung von Daten erfolgt nur, soweit dies rechtlich zulässig bzw. erforderlich ist. Empfänger sind insbesondere die Auftragsverarbeiter gemäß Art 28 DSGVO (siehe Punkt 10) sowie Behörden und Gerichte. Eine Übermittlung in ein Drittland (insbesondere in die USA an den KI-Dienstleister, siehe Punkt 4.3) erfolgt nur auf Grundlage geeigneter Garantien gemäß Art 44 ff DSGVO (Standardvertragsklauseln).

3.4 Data are disclosed or transferred only to the extent legally permissible or required. Recipients are, in particular, the processors pursuant to Art 28 GDPR (see point 10) as well as authorities and courts. A transfer to a third country (in particular to the USA to the AI service provider, see point 4.3) takes place only on the basis of appropriate safeguards pursuant to Art 44 ff GDPR (standard contractual clauses).

3.5 Es findet keine ausschließlich automatisierte Entscheidungsfindung im Sinne des Art 22 DSGVO statt. Die eingesetzte Künstliche Intelligenz unterstützt die Person, stellt Fragen und macht Vorschläge – die Entscheidungen trifft ausschließlich die betroffene Person selbst. Ein Profiling findet nicht statt.

3.5 No solely automated decision-making within the meaning of Art 22 GDPR takes place. The artificial intelligence used supports the person, asks questions and makes suggestions – decisions are made exclusively by the data subject. No profiling takes place.

4. Erhebung und Verarbeitung von Daten

4. Collection and processing of data

4.1 Technische Daten beim Aufruf. Beim Aufruf der Plattform werden automatisiert notwendige technische Daten (Zugriffsdaten, siehe Punkt 7) zum Betrieb, zur Sicherheit und zur Optimierung verarbeitet. Rechtsgrundlage ist das berechtigte Interesse gemäß Art 6 Abs 1 lit f) DSGVO.

4.1 Technical data on access. When the platform is accessed, necessary technical data (access data, see point 7) are processed automatically for operation, security and optimization. The legal basis is the legitimate interest pursuant to Art 6(1)(f) GDPR.

4.2 Nutzung der ideatio-Werkzeuge mit Zugangscode (bezahlter Zugang). Nach dem Kauf erhält die Person einen Zugangscode, mit dem sie durch die fünf Stationen arbeitet. Die dabei eingegebenen Inhalte (Texte und Gedanken der Person) werden auf dem Server gespeichert, damit die Person an jedem Gerät weiterarbeiten kann und ihre Arbeit erhalten bleibt. Die Speicherung erfolgt ausschließlich unter dem pseudonymen Zugangscode – ohne Namen und ohne E-Mail-Adresse. Ein Rückschluss auf die Identität der Person ist aus diesen gespeicherten Inhalten allein nicht möglich (vgl. Art 11 DSGVO). Rechtsgrundlage: Erfüllung des Nutzungsvertrags gemäß Art 6 Abs 1 lit b) DSGVO (ergänzend berechtigtes Interesse gemäß lit f). Speicherdauer: bis zur Löschung durch die Person bzw. bis zum Wegfall des Zwecks.

4.2 Use of the ideatio tools with an access code (paid access). After purchase, the person receives an access code with which they work through the five stations. The content entered (the person's texts and thoughts) is stored on the server so that the person can continue on any device and their work is preserved. Storage takes place exclusively under the pseudonymous access code – without a name and without an email address. The identity of the person cannot be inferred from this stored content alone (cf. Art 11 GDPR). Legal basis: performance of the usage contract pursuant to Art 6(1)(b) GDPR (additionally legitimate interest pursuant to (f)). Storage period: until deletion by the person or until the purpose ceases to apply.

4.3 Verarbeitung durch Künstliche Intelligenz („der Funke“). Um Rückfragen und Vorschläge zu erzeugen, werden die von der Person eingegebenen Inhalte an den KI-Dienst von Anthropic (Anthropic PBC, San Francisco, Kalifornien, USA) übermittelt und dort verarbeitet. Übermittelt wird ausschließlich der eingegebene Inhalt – kein Name und keine E-Mail-Adresse. Anthropic verarbeitet die Inhalte als Auftragsverarbeiter gemäß Art 28 DSGVO ausschließlich zur Erbringung der Antwort; nach den Nutzungsbedingungen von Anthropic werden über die Programmierschnittstelle (API) übermittelte Inhalte nicht zum Training der KI-Modelle verwendet. Da Anthropic seinen Sitz in den USA hat, erfolgt eine Übermittlung in ein Drittland; diese ist durch Standardvertragsklauseln gemäß Art 46 DSGVO abgesichert. Rechtsgrundlage: Art 6 Abs 1 lit b) DSGVO.

4.3 Processing by artificial intelligence (“the spark”). In order to generate follow-up questions and suggestions, the content entered by the person is transmitted to and processed by the AI service of Anthropic (Anthropic PBC, San Francisco, California, USA). Only the entered content is transmitted – no name and no email address. Anthropic processes the content as a processor pursuant to Art 28 GDPR solely to provide the response; under Anthropic's terms of use, content transmitted via the programming interface (API) is not used to train the AI models. As Anthropic is based in the USA, a transfer to a third country takes place; this is safeguarded by standard contractual clauses pursuant to Art 46 GDPR. Legal basis: Art 6(1)(b) GDPR.

4.4 Kostprobe (kostenlose Testversion). Die in der Kostprobe eingegebenen Inhalte werden ausschließlich lokal im Browser der Person gespeichert (localStorage) und nicht an den Server übertragen. Die Funktion „PDF mitnehmen“ erzeugt das Dokument direkt im Browser. Es wird weder ein Name noch eine E-Mail-Adresse erfasst. Soweit in der Kostprobe die KI-Funktion genutzt wird, gilt für die Übermittlung der Eingaben an Anthropic Punkt 4.3; eine Speicherung dieser Eingaben auf dem Server findet nicht statt.

4.4 Taster (free trial version). The content entered in the taster is stored exclusively locally in the person's browser (localStorage) and is not transmitted to the server. The “take the PDF with you” function generates the document directly in the browser. Neither a name nor an email address is collected. Insofar as the AI function is used in the taster, point 4.3 applies to the transmission of the entries to Anthropic; these entries are not stored on the server.

4.5 Kauf über Digistore24. Der Kauf von Zugängen wird über die Digistore24 GmbH (St. Ingbert, Deutschland) abgewickelt. Digistore24 erhebt dabei die für Kauf, Zahlung und Rechnungslegung erforderlichen Daten (z. B. Name, E-Mail-Adresse, Zahlungsdaten); es gelten die Datenschutzbestimmungen von Digistore24. Mag. Dr. Gerold Weiß erhält die für die Abwicklung und die Vergabe des Zugangscodes nötigen Bestelldaten. Rechtsgrundlage: Art 6 Abs 1 lit b) DSGVO.

4.5 Purchase via Digistore24. The purchase of access is handled via Digistore24 GmbH (St. Ingbert, Germany). In doing so, Digistore24 collects the data required for purchase, payment and invoicing (e.g. name, email address, payment data); the privacy provisions of Digistore24 apply. Mag. Dr. Gerold Weiß receives the order data necessary for processing and for issuing the access code. Legal basis: Art 6(1)(b) GDPR.

5. Erhebung von Daten bei Dritten

5. Collection of data from third parties

Mit Ausnahme der automatisch erhobenen technischen Zugriffsdaten (Punkt 7) und der über Digistore24 erhobenen Daten (Punkt 4.5) werden keine Daten verarbeitet, die nicht bei den betroffenen Personen selbst erhoben werden.

With the exception of the automatically collected technical access data (point 7) and the data collected via Digistore24 (point 4.5), no data are processed that are not collected from the data subjects themselves.

6. Dauer der Datenverarbeitung, Speicherdauer

6. Duration of processing, storage period

6.1 Daten werden nicht dauerhaft gespeichert, sondern nur in Übereinstimmung mit den gesetzlichen Fristen, jedenfalls aber so lange, als dies für die Zwecke erforderlich ist, für welche sie erhoben wurden.

6.1 Data are not stored permanently, but only in accordance with the statutory time limits, and in any case only as long as this is necessary for the purposes for which they were collected.

6.2 Werden Daten nur auf Grundlage einer Einwilligung verarbeitet, werden sie nach einem Widerruf gemäß Art 7 Abs 3 DSGVO unverzüglich gelöscht. Gleiches gilt bei berechtigtem Widerspruch gemäß Art 21 DSGVO.

6.2 Where data are processed solely on the basis of consent, they are deleted without undue delay following a withdrawal pursuant to Art 7(3) GDPR. The same applies in the event of a legitimate objection pursuant to Art 21 GDPR.

7. Zugriffsdaten beim Aufruf (Server-Logfiles)

7. Access data on access (server log files)

7.1 Beim Aufruf der Plattform werden Daten technischer Natur automatisiert verarbeitet und in Server-Logfiles gespeichert: IP-Adresse, Art und Version von Betriebssystem und Browser, Dateiname und -pfad, Übertragungsprotokoll, Datum und Uhrzeit des Zugriffs, übertragene Datenmenge, Referrer-URL und anfragender Provider. Das Hosting erfolgt bei der Hetzner Online GmbH (siehe Punkt 10).

7.1 When the platform is accessed, data of a technical nature are processed automatically and stored in server log files: IP address, type and version of operating system and browser, file name and path, transfer protocol, date and time of access, volume of data transferred, referrer URL and requesting provider. Hosting is provided by Hetzner Online GmbH (see point 10).

7.2 Diese Zugriffsdaten werden nicht zur Identifizierung von Personen verarbeitet, sondern ausschließlich zum Betrieb, zur Sicherheit, zur Fehlerbehebung und zur Optimierung der Plattform. Ein Profiling findet nicht statt. Die Zugriffsdaten werden nach 14 Tagen gelöscht.

7.2 These access data are not processed to identify individuals, but exclusively for the operation, security, troubleshooting and optimization of the platform. No profiling takes place. The access data are deleted after 14 days.

8. Cookies und lokale Speicherung im Browser

8.1 ideatio setzt keine Tracking- oder Marketing-Cookies ein. Für den Betrieb technisch notwendig ist die lokale Speicherung im Browser (localStorage): Der Zugangscode wird lokal gespeichert, damit die Person angemeldet bleibt, und die Kostprobe speichert die Eingaben lokal, damit die Arbeit nicht verloren geht.

8.1 ideatio does not use tracking or marketing cookies. Local storage in the browser (localStorage) is technically necessary for operation: the access code is stored locally so that the person stays signed in, and the taster stores entries locally so that the work is not lost.

8.2 Diese technisch notwendige lokale Speicherung erfolgt auf Grundlage des berechtigten Interesses gemäß Art 6 Abs 1 lit f) DSGVO bzw. ist für die vertragsgemäße Nutzung erforderlich. Die Person kann diese Daten jederzeit über die Browsereinstellungen entfernen.

8.2 This technically necessary local storage takes place on the basis of the legitimate interest pursuant to Art 6(1)(f) GDPR or is required for the contractual use. The person can remove these data at any time via the browser settings.

9. Schriftarten

9. Fonts

Die auf der Plattform verwendeten Schriftarten („'Libre Caslon Text'“ und „Inter“) sind lokal auf dem Server eingebunden. Beim Laden der Schriften werden keine Daten an Dritte übermittelt.

The fonts used on the platform (“'Libre Caslon Text'” and “Inter”) are embedded locally on the server. No data are transmitted to third parties when the fonts are loaded.

10. Datenverarbeitung im Auftrag (Auftragsverarbeiter)

10. Processing on behalf of the controller (processors)

10.1 Erfolgt eine Verarbeitung im Auftrag, wird nur mit Auftragsverarbeitern im Sinne des Art 4 Z 8 DSGVO gearbeitet, die hinreichende Garantien bieten. Dazu werden Verträge gemäß Art 28 DSGVO geschlossen; bei Auftragsverarbeitern in Drittstaaten werden die Art 44 ff DSGVO beachtet.

10.1 Where processing is carried out on behalf of the controller, only processors within the meaning of Art 4(8) GDPR that provide sufficient guarantees are used. Contracts pursuant to Art 28 GDPR are concluded for this purpose; for processors in third countries, Art 44 ff GDPR are observed.

11. Sicherheit der Datenverarbeitung

11. Security of processing

Unter Berücksichtigung der Kriterien des Art 32 DSGVO werden angemessene technische und organisatorische Maßnahmen getroffen, sodass die Daten vor unbefugter oder unrechtmäßiger Verarbeitung sowie vor Verlust, Beschädigung und Veränderung geschützt werden.

Taking into account the criteria of Art 32 GDPR, appropriate technical and organizational measures are taken so that the data are protected against unauthorized or unlawful processing as well as against loss, damage and alteration.

12. Rechte der betroffenen Personen

12. Rights of data subjects

12.1 Die Rechte der betroffenen Personen werden nach Maßgabe der geltenden Rechtsvorschriften gewahrt. Ersuchen können – empfohlenerweise in Textform (z. B. Brief oder E-Mail) – an Mag. Dr. Gerold Weiß gerichtet werden (Kontaktdaten siehe Punkt 1.1). Da die in den Werkzeugen gespeicherten Inhalte nur unter dem pseudonymen Zugangscode abgelegt sind, kann zur Bearbeitung eines Ersuchens die Angabe des Zugangscodes erforderlich sein (Art 11 DSGVO).

12.1 The rights of data subjects are safeguarded in accordance with the applicable legal provisions. Requests can be addressed – preferably in text form (e.g. letter or email) – to Mag. Dr. Gerold Weiß (contact details see point 1.1). As the content stored in the tools is filed only under the pseudonymous access code, providing the access code may be necessary in order to process a request (Art 11 GDPR).

Den betroffenen Personen stehen zu: das Recht auf Auskunft und Information (Art 13–15 DSGVO), auf Berichtigung und Vervollständigung (Art 16 DSGVO), auf Löschung (Art 17 DSGVO), auf Einschränkung der Verarbeitung (Art 18 DSGVO), auf Datenübertragbarkeit (Art 20 DSGVO), das Widerspruchsrecht (Art 21 DSGVO), das Recht, nicht einer ausschließlich automatisierten Entscheidung unterworfen zu werden (Art 22 DSGVO), sowie das Widerrufsrecht für erteilte Einwilligungen (Art 7 Abs 3 DSGVO).

Data subjects have the following rights: the right of access and information (Art 13–15 GDPR), to rectification and completion (Art 16 GDPR), to erasure (Art 17 GDPR), to restriction of processing (Art 18 GDPR), to data portability (Art 20 GDPR), the right to object (Art 21 GDPR), the right not to be subject to a solely automated decision (Art 22 GDPR), as well as the right to withdraw consent given (Art 7(3) GDPR).

12.2 Beschwerderecht: Gemäß Art 77 DSGVO iVm §24 DSG besteht das Recht auf Beschwerde bei der Aufsichtsbehörde: Österreichische Datenschutzbehörde, Barichgasse 40–42, 1030 Wien, dsb@dsb.gv.at. Zudem besteht das Recht auf einen wirksamen gerichtlichen Rechtsbehelf (Art 79 DSGVO).

12.2 Right to lodge a complaint: pursuant to Art 77 GDPR in conjunction with §24 DSG, there is a right to lodge a complaint with the supervisory authority: Austrian Data Protection Authority (Österreichische Datenschutzbehörde), Barichgasse 40–42, 1030 Vienna, dsb@dsb.gv.at. There is also the right to an effective judicial remedy (Art 79 GDPR).
